Terms of Service

These Terms of Service ("Terms") govern your access to and use of the HyFabric website, APIs, and proxy infrastructure services (collectively, the "Services"). Please read these Terms carefully before using our Services.

1. Acceptance of Terms

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Services. If you are accessing the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

HyFabric provides high-performance, Rust-powered proxy infrastructure and related networking tools. The Services are provided "as is" and "as available," and we reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice.

3. Account Registration and Responsibilities

To access certain features of the Services, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during the registration process.
  • Maintain the security and confidentiality of your account credentials.
  • Be strictly responsible for all activities that occur under your account.
  • Notify us immediately of any unauthorized use of your account or any other breach of security.

4. Prohibited Uses

You agree not to use the Services for any unlawful or prohibited purpose. Specifically, you agree not to use the Services to:

  • Transmit any material that is illegal, abusive, harassing, or otherwise objectionable.
  • Engage in any activity that interferes with or disrupts the Services or the servers and networks connected to the Services.
  • Attempt to gain unauthorized access to any portion of the Services or any other systems or networks connected to the Services (e.g., hacking, brute-forcing, or port scanning).
  • Distribute malware, viruses, or any other harmful code.
  • Engage in spamming, phishing, or other fraudulent activities.

Violation of these prohibited uses may result in immediate termination of your account without a refund, and may subject you to state and federal penalties.

5. Payment and Billing

Certain aspects of the Services may be provided for a fee. You agree to pay all applicable fees related to your use of the Services.

  • Subscriptions: Fees are billed in advance on a recurring basis.
  • Cancellations: You may cancel your subscription at any time. Cancellations will take effect at the end of the current billing cycle.
  • Refunds: Except as required by law or explicitly stated otherwise, all payments are non-refundable.

6. Intellectual Property

All rights, title, and interest in and to the Services, including all associated intellectual property rights, are and will remain the exclusive property of HyFabric and its licensors. You may not copy, modify, distribute, sell, or lease any part of our Services without our explicit written consent.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, HYFABRIC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

IN NO EVENT SHALL HYFABRIC, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; OR (III) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms.
